Upon receiving your appraisal request, if the item is interesting for our auctions, we will provide you with an estimation and we will propose and set a reserve price. The reserve price is the minimum amount (minus commission - typically 10%) at which the item can be sold. If this price is not reached at auction, the lot will be deemed unsold.

The final sale price will be the highest bid received at auction, which must be equal to or higher than the agreed-upon reserve price. This price will be deducted from the auction fees due to Zaphira. The auction fee is calculated as a variable percentage of the hammer price:
- 10% (VAT included) on the portion of the hammer price up to €20,000
- 8% (VAT included) on the portion from €20,000 to €100,000
- 5% (VAT included) on the portion exceeding €100,000

If you decide to entrust your items for sale, Zaphira will assist you with all the procedures. Upon delivery of the items, you will be issued a document (sales mandate) containing the list of items, reserve prices, commission, and any insurance costs, photographs, and shipping, as well as the expected sale dates. You will need to provide an identity document and bank informations to make the payment to the name of the person holding the sales mandate.

Before each auction, the consignor receives a communication with the list of items included in the catalogue and the relative lot numbers. It is possible that not all lots of the property are in the same auction, for this reason there may be multiple notices for inclusion in different auctions.

After the auction, we will notify you of the outcome of the sale. Commission fees will be deducted from the final result, and the remaining net amount will be calculated for you. The notice of sale refers to each auction; not all lots of the property may be included in the same auction, so multiple notifications may be expected.

In the event of a sale, after 25 days from the auction date, and provided that the buyer's payment has been completed, Zaphira will pay the seller. In the event of non-payment by the buyer, Zaphira will not act as their agent, and the sale will be canceled and the item will be considered unsold. If a late payment is reported because the buyer is finalizing payment more than 25 days after the auction, Zaphira will notify the seller of this eventuality, who may, in this case, decide to withdraw the sale.

Any unsold lots will be made available for collection or relisted at a subsequent auction, if you wish, with a new reserve price. In the event of a return, depending on the agreement made during the auction, the item may be collected or shipped to the seller. This cost must be specified during the auction whether it will be borne by the seller or by Zaphira. In the event of a markup in a subsequent auction, a 20% reserve reduction is recommended.

As a member state of the European Union, Malta has implemented Directive 2001/84/EC, which regulates the right of the author of a graphic or plastic work of art to receive a percentage of the sale price of resales subsequent to the first transfer. This fee is due if the sale price is not less than €3,000.00 and is determined as follows:
- 4% for the portion of the sale price between €3,000 and €50,000;
- 3% for the portion of the sale price between €50,000.01 and €200,000;
- 1% for the portion of the sale price between €200,000.01 and €350,000;
- 0.5% for the portion of the sale price between €350,000.01 and €500,000;
- 0.25% for the portion of the sale price exceeding €500,000.
Therefore, if the lot is subject to the so-called "resale right," Zaphira undertakes to pay the amount calculated in accordance with the law to the collection agency on behalf of the seller.

In the event of a dispute with the buyer, Zaphira will hold the sale and payment for the item until the matter is resolved. There is a possibility that items may be disputed after the auction by buyers upon receipt. Zaphira will determine whether these disputes are valid (forgeries, major errors, or missing key information unseen by Zaphira and the seller). If they are true, Zaphira will refund the buyer and the sale will be canceled. For this reason, Zaphira will withhold payment for 14 days from the buyer's receipt of the lot due to the buyer's right of withdrawal (with just cause).
